By accessing or using Misplaced Histories ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Misplaced Histories is operated by This Human Experience, LLC, a North Carolina limited liability company ("we," "us," or "our").
Misplaced Histories is a location-based mobile application that uses artificial intelligence to generate historical stories about places on earth. Stories are generated on demand using your device's location and publicly available historical sources including Wikipedia, the Library of Congress Chronicling America archive, the National Park Service, and OpenStreetMap.
Stories are AI-generated narratives intended for entertainment and general interest. They are not certified historical records, academic research, or journalism.
You must be at least 13 years of age to use the App. By using the App you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
To access the full features of the App you must create an account using Google authentication or email. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate information when creating your account and to update that information if it changes. We reserve the right to suspend or terminate accounts that contain false or misleading information.
Free Tier: New users receive 20 complimentary story generations. These are provided as a one-time trial and do not reset.
Paid Subscription: After exhausting your free stories, continued use of the App requires a paid subscription. Subscription options include:
Subscriptions are billed through Stripe. By subscribing you authorize us to charge your payment method on a recurring basis until you cancel.
Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.
Price Changes: We reserve the right to change subscription pricing. We will provide at least 30 days notice of any price increase to active subscribers.
All historical stories generated by the App are produced using artificial intelligence. While we use verified historical sources as inputs, the AI-generated output may contain inaccuracies, omissions, or errors.

If you believe a story contains a significant factual error, you may report it using the thumbs down feature within the App. We use this feedback to improve story quality over time.

This Human Experience, LLC expressly disclaims responsibility for any decisions made, actions taken, or conclusions drawn based on AI-generated story content. Stories are provided for entertainment and general interest only and should not be relied upon for historical research, educational certification, legal proceedings, or any purpose requiring verified factual accuracy.
We are committed to continuous improvement of story quality through user feedback mechanisms including the thumbs down reporting feature. We encourage users to report stories that appear inaccurate, biased, or offensive.
Our Content: The App, its design, interface, branding, and all non-user-generated content are owned by This Human Experience, LLC and protected by applicable intellectual property laws.
Generated Stories: AI-generated stories produced by the App are owned by This Human Experience, LLC. You may share individual stories for personal, non-commercial purposes with attribution to Misplaced Histories.
Source Material: The App draws on publicly available sources including government publications, open-licensed databases, and Creative Commons content. We acknowledge OpenStreetMap contributors in accordance with the Open Database License.
Feedback: Any feedback, suggestions, or ideas you submit regarding the App may be used by us without compensation or attribution to you.

The App uses your device's location to find historical stories near you. See our Privacy Policy for a full description of how location data is collected, used, and protected.
You may deny location permission, in which case the App will function in a limited capacity centered on a default location.
The App integrates with third party services including Google (authentication), Stripe (payments), ElevenLabs (audio narration), and mapping providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third party services.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS HUMAN EXPERIENCE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless This Human Experience, LLC and its members, officers, and agents from any claims, damages, or expenses arising from your use of the App or your violation of these Terms.
These Terms are governed by the laws of the State of North Carolina without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Buncombe County, North Carolina.
We reserve the right to modify these Terms at any time. We will notify active subscribers of material changes via email at least 14 days before they take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
